Will of John E. Roberts

I John E. Roberts of sound mind and memory and in view of the uncertainties life do make and publish this my last Will and Testament.

Item first:
I will and devise to my wife Catherine Roberts lots one in Block one in the first survey of Bethany, Harrison County Missouri for her natural life and at her death the fee simple title thereof to revert to and invest in my heirs at law.

Item Second:
I will and devise to my daughter Semantha Elizabeth Hamilton for her natural life the following described real estate to wit: A part of lot the boundary line of which commences at the south east corner of lot 12 in the fourth survey of the town (now city) of Bethany, Missouri - - - the fee simple title thereof at her death to revert to and vest in the heirs of the body of her the said Semantha Hamilton.

Item the third:
I direct my executor hereinafter appointed to collect all debts due me at the time of my death, to sell all my personal property except my household goods, also to sell and convey all the real estate of which I may die seized of in law or equity, except that above specifically devised, in such time and on such terms as my executor may deem for the best interest of my estate.

Item the fourth
Out of the proceeds of such collections and of the sales of personal and real property aforesaid, I direct first that my Executor pay all just debts and funeral expenses. Second that my Executor pay to my wife Catherine the sum of $400 which sum together with the said devise of the 1 Block 1 Bethany, Missouri, if accepted by my wife shall be held in lieu of her dower in and right to any other portion of my real or personal estate.

Item the fifth
Of the residue of said collections and sales of real and personal property after the ppropriations in item fourth, I direct my Executor to take 1/7 thereof and invest same in real estate to be deeded to my daughter Semantha E. Hamilton for her natural life with reversion to the heirs of the body of her the said Samantha, or the said 1/7 at the election of said Semantha shall be by my executor invested in safe stocks or loaned out on good security and the annual product or income of which to be paid to said Semantha during her natural life, and at her death the whole to be paid over to the heirs of her body.

Item the sixth,
The residue of my Estate after deducting the specific legacies and appropriations mentioned in the preceding items of this Will, I bequeath in equal shares to the following named children, to wit: Mariam McClain, Wilford W. Roberts, Mary Ann Tonroy, Charles H. Roberts, John C. Roberts and Isaac M. Roberts and I direct my Executor to pay same to them.

I appoint Isaac M. Roberts my son my sole Executor and authorize him to execute and carry out the provisions of this Will.

In witness whereof I have hereunto set my hand this July the 8th 1875.

Be it remembered that on this 6th day of Jan. AD 1876, before me the Judge of Probate Court held in and for the County and State aforesaid, personally appeared Daniel S. Alvord and Hardy M. Cuddy who are the subscribing witnesses to the annexed will of John E. Roberts deceased and being by me first duly sworn depose and say that the said John E. Roberts the testator subscribed the same in their presence and published and declared said will or instrument of writing to be his last Will and Testament and that at the time of signing the same, he the said testator was of sound and disposing mind and more than 21 years of age and that the said deponents attested said will as witnesseshereto by subscribing their names to the same in the presence of the testator and each other, and at the request of the said testator.
